1. Introduction

These Terms govern registration and use of the ABC Sarathi Driver App operated by AUBICA SMART RIDE PRIVATE LIMITED (“Company”, “we”, “us” or “our”). ABC Smart Ride is a technology platform that connects riders with independent drivers providing eligible motorcycle, auto-rickshaw and cab transportation services, subject to availability and applicable law.

By registering, accessing the Driver App or accepting ride requests, you agree to these Terms and the Driver Privacy Policy.

2. Eligibility and Registration

• Be legally eligible to drive the relevant vehicle in India and hold the required licence.
• Provide accurate personal and contact information.
• Complete identity and document verification required by the Company.
• Provide valid vehicle documents where applicable.
• Keep documents current and notify the Company if they expire, are suspended or become invalid.
• Registration does not guarantee approval, ride availability or earnings.

3. Identity and Vehicle Documents

Depending on the vehicle category and applicable requirements, the Company may request driving licence, registration certificate, insurance, PUC, fitness certificate, permits, identity/address documents, and verification information where lawfully required. You must provide genuine documents and must not impersonate another person or use another person's account. Access may be restricted while expired or disputed documents are verified.

4. Account Ownership and Security

• Use only your own approved account.
• Do not share, rent, sell or transfer the account without written authorization.
• Keep credentials and OTPs confidential.
• Do not manipulate GPS, create fraudulent trips or falsify ride completion or wallet-credit records.
• Notify support promptly about suspected unauthorized access.

5. Vehicle Eligibility and Responsibilities

Use only an approved vehicle legally permitted for the service. You are responsible for roadworthiness, maintenance, valid registration, insurance, permits, fitness certificates and compliance with traffic rules and passenger-safety requirements. Do not carry more passengers than legally permitted.

6. Nature of the Relationship

ABC Smart Ride provides a technology platform connecting riders and independent drivers. Unless a separate written agreement or applicable law provides otherwise, use of the platform alone does not make a Sarathi an employee, partner or agent of the Company. Nothing in these Terms removes rights or obligations imposed by applicable law.

7. Ride Requests and Acceptance

• Requests depend on availability, location, service type and platform operations.
• Accept or decline requests using the app's available functionality and applicable rules.
• After accepting a ride, make reasonable efforts to reach pickup and complete the trip safely.
• Keep availability and trip status accurate.
• Do not mark a ride completed before it ends or collect a fare for a trip not performed.
• Do not ask a rider to cancel for a fraudulent or misleading purpose.

8. Rider Fares and Direct Payments

The Rider App and Driver App may display a fare or fare estimate. Riders pay drivers directly using a payment method mutually agreed upon and available for the ride, such as cash, UPI or another method accepted by the driver.

ABC Smart Ride does not collect, receive, hold or transfer the rider's fare between rider and driver. The driver-credit wallet described below is separate from the rider fare and must not be represented as a wallet for receiving or settling passenger payments.

You must communicate fares honestly, must not demand unauthorized charges and must not falsify payment or trip records. Fare disputes are primarily between the rider and driver, although the Company may review platform-related complaints.

9. ABC Ride Credits Wallet and Platform Charges

The Driver App provides an internal wallet through which a Sarathi may add funds to purchase ABC Ride Credits. These credits are used only for the driver's platform usage charges under the ABC Smart Ride service. They are separate from rider fares and are not a means of receiving, holding or transferring money paid by riders.

• Before purchasing credits or using a ride subject to a credit deduction, review the price, credit conversion (if any), applicable deduction rate and other terms displayed in the app.
• After a ride is completed, the applicable number or amount of ABC Ride Credits is deducted from the driver's wallet according to the rate disclosed by the Company in the app.
• The Company should clearly display the applicable deduction rate and any applicable taxes or fees before the driver is charged. If the app does not clearly disclose these details, the Company should correct the flow before launch.
• Wallet top-ups and credit deductions may be recorded in a transaction history for reconciliation, support, fraud prevention and legal compliance.
• ABC Ride Credits are platform credits, not a bank deposit, bank account, cash balance or rider payment balance. They cannot be used to pay a rider's fare.
• Credits are personal to the approved driver account and may not be sold, transferred or exchanged for cash, except where required by applicable law or expressly stated in a written Company policy.
• Top-up failures, duplicate charges, incorrect deductions and refund requests may be reported to support. Refunds or reversals will be handled according to the terms displayed at purchase and applicable law.
• Do not assume that credits expire or are refundable unless the applicable in-app terms say so. Any expiry, refund, suspension or balance treatment must be clearly disclosed before purchase and applied consistently with law.
• The Company may investigate suspected top-up fraud, chargebacks or manipulation and may temporarily restrict wallet functions where reasonably necessary to protect users or the platform.

The Company does not charge a separate joining fee under the current model. The per-ride credit deduction is a platform usage charge and must be disclosed separately from the fare paid by the rider to the driver.

10. Driver Conduct and Passenger Safety

• Treat riders and the public respectfully.
• Follow traffic laws and operate the vehicle safely.
• Never drive under the influence of alcohol, drugs or any substance that makes driving unsafe or unlawful.
• Avoid harassment, discrimination, threats, violence and unwanted contact.
• Keep the vehicle reasonably clean and safe.
• Respect rider privacy and keep personal information confidential.
• Report serious accidents, safety incidents and suspected criminal activity promptly to appropriate authorities and the Company.
• Do not retaliate against a rider for submitting a complaint.

11. Insurance, Accidents and Liability

You are responsible for maintaining legally required vehicle insurance and documents. Do not assume that the Company provides personal accident, health or commercial vehicle coverage unless a specific written policy confirms it. In an accident, prioritize safety, contact emergency services when necessary, meet legal reporting duties, notify the Company and cooperate with lawful investigations. Each party remains responsible to the extent required by law for its own acts and obligations.

12. Location Tracking and Permissions

The Driver App may use GPS and other location information for availability, nearby ride requests, pickup coordination, trip progress and safety or dispute resolution. If location is accessed while the app is minimized or not visible, that use must correspond to a feature actually implemented, be appropriately disclosed and comply with Android and Google Play requirements. You can manage permissions in device settings; disabling location may limit location-dependent features.

13. Complaints and Investigations

The Company may investigate safety complaints, identity issues, fraudulent activity, fare disputes, wallet-credit discrepancies, misconduct, document validity or platform misuse. It may review relevant booking records, trip data, wallet transaction records and evidence reasonably needed for the investigation. Temporary restrictions may be applied where necessary to protect users, public safety or platform integrity. Where appropriate and legally permissible, the Company will explain significant restrictions and provide a review route.

14. Suspension, Termination and Deletion

Access may be suspended or terminated for invalid documents, suspected fraud, impersonation, serious safety complaints, unauthorized account sharing, material breach of these Terms or legal requirements. You may request deletion of your ABC Sarathi Driver App account using either of the following options:

Option 1 — Delete your account inside the Driver App

1. Open the ABC Sarathi Driver App and sign in.
2. Open Account/Profile and select the account-deletion or Delete Account option.
3. Read the on-screen notice and confirm the deletion request.
4. Complete any in-app verification steps and retain the confirmation shown by the app.

Option 2 — Request deletion through Customer Care

If you cannot use the in-app option, contact Customer Care using one of the following:

Include your registered mobile number, your name (if registered) and a clear request to delete your driver account. We may ask for reasonable information to verify ownership. Never send your password, OTP, UPI PIN or full payment credentials.

Deletion and retained records

Deletion does not mean every record can immediately be erased. We will delete personal information that is no longer required, subject to lawful retention obligations and legitimate exceptions. Wallet top-up, ABC Ride Credits purchase, credit-deduction and transaction-ledger records may be retained for accounting, fraud prevention, dispute resolution or legal compliance for the applicable period.

ABC Ride Credits and unresolved wallet matters

Review any remaining ABC Ride Credits balance and any pending top-up, deduction or refund dispute. Remaining credits, refunds and unresolved claims will be handled under the disclosed wallet terms and applicable law. Contact Customer Care if you need to raise a wallet-related question as part of your request.

15. App Availability and Intellectual Property

We aim to maintain a reliable platform but do not guarantee uninterrupted access, a minimum number of rides, a particular earnings level or continuous availability of every feature. The app, branding, software and content are protected by applicable intellectual-property laws. Use the app only for its intended lawful purpose.

16. Changes to These Terms

We may update these Terms to reflect platform, wallet-credit, safety or legal changes. Material changes will be communicated and consent obtained where required. Updated terms will be published on the website.

17. Governing Law and Disputes

These Terms are governed by the laws of India, subject to mandatory legal protections. Disputes will be addressed through appropriate complaint processes and competent courts or authorities having jurisdiction under applicable law.
